Attorney General Swanson Sues Fence Company That Kept Prepayments From Customers For Fences It Never Actually Installed.

Attorney General Lori Swanson recently filed a lawsuit against Alpine Fence Company, LLC (“Alpine”) under Minnesota’s consumer protection laws for allegedly soliciting large prepayments from customers for fences it never subsequently built. The company’s owner, Chad Thompson, is also named as a defendant in the lawsuit.
The lawsuit alleges that Alpine and Thompson deceptively solicited prospective customers by claiming that Alpine was a Better Business Bureau (“BBB”) Accredited Business, when in fact its accreditation had been revoked. Alpine’s website and contracts with customers featured the BBB logo and stated that Alpine was a “Better Business Bureau Member.” Thompson also falsely told customers that Alpine was a BBB Accredited Business. Once customers hired Alpine, it required them to make up to a 50% prepayment of their total contract price at the time they signed their contract with Alpine. These prepayments ranged from around $1,500 to almost $6,000. Alpine then failed to actually install fences for some customers. When customers canceled their contracts and sought a refund due to Alpine’s failure to perform, Thompson was unresponsive to their requests and failed to make refunds of customers’ prepayments.
The lawsuit was filed in Hennepin County District Court against Alpine Fence Company, LLC and Chad Thompson, individually. The suit seeks injunctive relief, civil penalties, and restitution for victims of the company’s practices.
